You're taking the definition of illegal to be a sticking point. Even in AC if they thought you were card counting, they would employ several methods to stop it, therefore nobody does it, and nobody young does it any more. the bottom line is you cant do it, and it wont help you win. Plus they use 8 decks, online the shuffle is random, so there isnt even a deck per se, soon they will be using digital systems in person. so it will be more like video blackjack than real blackjack.

There is only one reason why card counting is not illegal. The courts have said it is not illegal. States cannot pass laws to make it illegal. Everything else is irrelevant. Card counters went to court to ensure it was legal. The casinos went to defend their position. The casinos realize card counting transfers the odds to the favour of the counters, not by much but enough to give them concern. If card counting is no big deal, why do casinos ban them? Yes you can win by card counting and yes it does help you win. It's all about the slight edge the card counters have that worries the casino, if not they would say " have at it folks" and never ban them.

They probably do have several methods to hamper the card counter but their easiest solution is to just ban them except in New Jersey where they can't ban them. It's not about people not doing it anymore, there are still card counters out there, old and young. By banning them, the casinos are discouraging anyone from even trying.
