Jody,
I had fixed that error on my end but posted the unedited version by mistake. (there's a few other errors I need to fix in word usage as well). SESAC is a For Profit Company. They are only a tiny fraction the size of ASCAP and BMI and I've never heard of them strong arming any venues, but I do know at least some venues pay them a fee because I've seen SESAC stickers on their doors indicating they do.
Larry: If an ASCAP writer performs at a venue, wouldn't that still be a violation? I can see if only non-affiliated songs are performed where that would be exempt.. but for example, if I co-write a song with a BMI and ASCAP writer and perform it at a show, I don't think I have the legal right to waive their fees. The odds of NO ASCAP/BMI/SESAC songs ever being played in a venue with live music 7 days a week is miniscule. So, it seems like we need clarification: Who has the right to waive PRO collections? Does formal notice need to be given to do so? And we all know it's impossible in practical terms for a venue to really know what is and isn't an ASCAP song. Placing a sign up shouldn't remove them from responsibility, which is sounds like is the root of the lawsuit. I think BOTH sides of that lawsuit are in the wrong.
As for forwarding my suggestions: My perception is that they would fall on VERY deaf ears. I've met some great people attached to the PRO's, but I have also found many to be less than interested in listening/helping, especially at the corporate offices. Some of the reps are great though.
It would be helpful to have some PRO reps here to give their feedback. Feel free to have yours chime in.
