Thanks for an intense email exchange with another artist, so far the only one I've met who actually has an Orchard termination and was still on BuyMusic. As of yesterday at 5 p.m. pst. I was terminated from the Orchard's list and have subsequently been pulled from BuyMusic.
Pardon me, while I explain what I did...
On the Orchards FAQ page there is a little section on what you need to send them in order to start the termination process. You have to provide them with certain information. I.e. Artist name, Artist ID (at the Orchard), the UPC, the name of the release, your shipping address. I also included a list of reasons for why I wished to be let go. I was told directly that if you actually have another distribution company doing the distribution that that is your best explanation but they are going to want to know who it is and why. It also didn't hurt that I informed them that everything I was sending and receiving from them was going straight into my lawyers hands.
So right now, I've actually stood down my lawyers and anyone wishing to try the request for termination route is welcome to. Otherwise if you need a reference for a good attorney or two I've got a whole bunch now from which to choose. One's I know, one's recommended, and some from my PRO - SESAC.
So far the only person I've met through this ordeal who can still claim copyright infringement without a fuss is Andre - your stuff is still on BuyMusic and if you have that termination letter they sent you, fax your request along with that letter to BuyMusic and they will swiftly remove the disc. I didn't get a chance to tell them, mine's already removed. As it has been explained to me, even an email originating from the Orchard stating termination is legal and binding in a court of law. Just print a hard copy of it so you don't lose it.
I can assure you all that no other contract for the rest of my life will contain the word "perpetuity".
