should be interesting, their album is a top the Euro and domestic charts , and it's the title track that is the basis of the suit, i would imagine there is a few dollars to quabble over on this one...

Unless this is a CLEAR case of plagiarism, I think that filing suits like this only impedes creativity. The verse melody of The Red Hot Chili Pepper's 'Dani California' is almost identical to the verse structure of Tom Petty's 'Last Dance for Mary Jane'. Could Petty sue? Sure. Will he? No. He has stated in interviews that he doesn't think the songs are similar enough to merit a charge of plagiarism and that lawsuits will only ruin creativity in the music business. Unfortunately, lawyers and CEOs feel differently and will go after any dollar they can smell. The ONLY reason this suit was probably filed is because the song is making mega $$$. But I will hold judgment until I have the time to listed to the songs myself.

Sounds like a ripoff to me, too. Inoticed one of the comments said something like "Yeah they're close but I don't think they ripped Joe off. It;s just coincidence." I guess that commenter doesn;t realize that in the court of law, coincidence is no defense. Whether intentional or not, it is still copyright infringement.

I always find it interesting how many folks will defend artists they like, regardless of the evidence and/or facts, just because they like that artist. Interesting!

I actually caught that myself when I heard the first YouTube clip. I am a fan of Jefferson Starship and Marty Ballin and listen to the combined Jefferson Airplane/Starship Starship greatest hits which this is on a lot. You can usually bring up even older examples of the same melody and progressions of most pop songs to point to. So Marty should sue both Joe and Coldplay and really rake in some bucks.

Mike you should make a YouTube clip showing the similarities between all 3. You might get a half millions hits too. = )

By the way, I see a quick settlement in Joe's future... the two songs track exactly the same and they can show access via the attendance of the coldplay guy at Joe's show before they did this current album. But I think someone should bring up the Heart's song to really screw the pooch.

I listened, and yeah, they are similar for sure! BUT, being a very simple melody and WAY used chord progression, it doesn't mean it was ripped off. We all hear thousands of songs, and when we get something new for us, it may be from a combination of songs before, or even a particular song WITHOUT realizing that.

Would have to prove access to hearing the song, and to have melody notes match up just so, (for said amount of notes needed for that). there are a few notes that don't match up, with the vocal going down at the end of the line.

Buddy and I wrote a song once that a short time later, we heard nearly the SAME verse and chorus melody and chord progression, (about the same percentage as this example). The thing was, our song was not recorded, and not heard by anyone but our wives when the other song came out. So, I bet that sort of thing happens over and over. As well as many examples like Coldplay's with songs such as the famous L pattern songs and many similar melodies of same. Chuck Berry and Little Richard could sue about ten thousand songwriters or more if going on playing and singing basic progression and melodies as in this example. TOO basic of both to not have even other songs match up ot them. (Counting the unsigned artists and all not getting airplay, but have THAT song too, (in one way or another).

I don't know. I would have to "know" Cold play's specific access ot that other song, and that the intent of stealing was in place before hanging the dudes.

While I agree with John that the melody and progression are simple, matching them across each other a la the youtube clip is pretty creepy.

Then Mike weighed in with the Marty Ballin 'Hearts' track and it all gets a bit much!

With Brian's info about the Coldplay rep at Satriani's concert I don't think Coldplay have a leg to stand on!

Actually, "Hearts" was written by Jesse Barish, a protege of Marty Balin's, who wrote several songs for him and the Jefferson Starship. Since Jesse's career never really took off, maybe he should jump on this bandwagon.

I bet musicians scratch their heads a lot wondering where they got a riff when they play.
I have this instinctive tendency do de-arrange something from it's natural order if I happen to run in to a melody that sounds too familiar, the rare occasion it happens.

I recall Jefferson Starship suing Aldo Nova because the riff to Fantasy sounded similiar to Jane, Jane, Jane.
But they sounded like 2 different songs to me.
I have not heard the other song that coldplay was supposed to have ripped off.

Personally, my favorite cd from them is Rush Of Blood To The Head.
I have not heard anything original that grabbed me like that since Nevermind came out.

Miracles and Count On Me are my favorite Jefferson Starship songs.

They sounded more original and not quite so familiar on those one's.
Marty Balin definitely had a unique voice and writing style.
At least to my ears.
He started the band, but threw his life down and ran off stage when the Hells Angels attacked a 12 year old, when they were still Jefferson Airplane.
I heard the band is doing concerts again with him.

The courts have become so frivolous it seems that any musician could be sued for just having an influence.

If you follow the links above, you'll see this is no frivolous claim. It's one of the most blatant I've ever seen in terms of using a matching melody. The Starship comparison isn't part of the case, but it does show that an even earlier melody was significantly close which might be an interesting counter argument. That happens sometimes where someone shows that the same lines to a song that someone says were stolen from them actually show up in an even earlier song, negating their claim and occassionally making them shut up before they get sued themselves. This is so close that a settlement from someone is coming. These things almost never go to trial unless it's clearly not infringement. If it's even close they settle.

Thanks for posting that music theory video link. It was very well done. Towards the end, the music instructor acknowledges that the chances are "slim" for the plaintiff, Joe Satriani. This is based on the fact that you can't copyright chord progressions (alone) and rhythm patterns and tempo speed unless it includes a specific melody (for an instrumental) or melody and lyrics for a complete song.

Most likely this will get settled out of court, especially if the melody is a virtual copy. All around an interesting case for music theory students to study and learn from.

well it's a rather simple chord progression, to that point it's easy to coincide in many melodies and happens to everyone so, but well then you think same melody and tempo too to the point of being able to overlay them hmmm, not, starts to be fishy...
what I don't understand is WHY, when it's obvious that everybody will point it out as a copy, in this case i think it's really obvious
one of the also quite strange cases i've seen out there is kaoru wada theme's for 3x3 eyes and Braveheart hyper famous soundtrack theme, they're ABSOLUTELY the same melody but the unknown japanese came earlier... sometimes unfortunately fair or not, the more known ends up to have an advantage ... in this cases (sigh!). I can't imagine how i'd feel
