We must be the only two Eagles fans here, Jim! Enjoyed that interview with Don Henley. I like hearing the "behind the scenes" about bands, etc. and how they reflect on the happenings over the years. (I always liked that show "Behind the Music", but think it went off years ago). "Take it to the Limit" and "Lyin' Eyes" are memorable for me but all of their songs strike me in one way or another. How about "Desperado".... https://www.youtube.com/watch?v=kCdjvTTnzDU .....that one will "sing" in my head for a while now that I've heard it again. And this lesser talked about one: "Wasted Time": https://www.youtube.com/watch?v=btdCKjVQ31AHe pours a ton of emotion in the delivery of that one...no one ever talks about the "pauses" in songs. Absoultley one of my favorite bands of all time. Their songs are amazing and the members of that band past and present were extroidinary. But they also benefitted from their TIMES.
The reason we know so many of their songs, and not just the hits is because they were in the early days of FM radio, with limited commercials. DJ;s would play the entire albums in their entireity. Then people BOUGHT the records and played them from one side to another. "LP" stood for "LONG PLAYING"
So yes. Amazing individuals. Extroidinary talents. Unbeliably wonderful songs. Perfect timing. Undeniable in every aspect.

Just recently it came to light that the Eagles are bringing a lawsuit against a hotel in Mexico for using the name "Hotel California". How can this be? First of all, titles of songs aren't copyright eligible in and of themselves. There are many examples of different songs with the same title. Second, they are going after an establishment that is outside the United States? Even if there could be a copyright infringement, doesn't that only apply to establishments located within the country of origin?

You can bring a lawsuit against anything. Doesn't mean they are going to win. The hotel is probably using certain branding things that are the Eagles' property. The logo, the photo layouts, etc. anything they could be using to conflict their brand can come under suit. The Eagles also brought a suit against an organization saving EAGLES in the wild. So you can sue any body for anything.
If they are using unlicensced merchandise or brands that are unique to the band, they can;t do that. But, as you said, being that it is in Mexico, they might not be subject to the same laws. After all, the key now is to do whatever you want until someone makes you stop.

I could write a song called "Hotel California" and I'd be free and clear. I could also write a song called "Margaritaville" and be free and clear....But there is a BIG! Big! difference 'tween "Copyrights"" and "Trademarks"...
And no, even with my fuzzy brain, I would have enough sense not to round up "investors" and open up a hotel called "Margaritaville"...
If Steven Hawking was a lawyer, perhaps he could explain it...Although even then, us mortals would have a hard time following....:-)

P.S....Have I ever mentioned that the best man at my latest wedding is one of the top 3 "patent" attorneys in the U.S.A.? We chat often...I tell him about copyrights, from a writer's perspective...And "Trademarks"....And he tells me about various "patent" lawsuits that he has worked on.....Often for over 5 years, all on "contingent" fees.
And then he wins the lawsuit on behalf of his client!!! But then the "contingent" money is still tied up for 5 years while repeals are filed.....And my best-man-lawyer-dude, told me:
Never hire a lawyer unless you can afford him and only expect a 5% return on your money if you win, because the lawyers and court costs will take the rest.

It all has to do with COPYRIGHT BRANDING. There are things you can copyright and trademark. Logos, certain trademarked items that are exclusively the property of the people who are branded them. My guess is that this hotel might have used many things in their advertising, in their promotions, in the decorations, etc. that identify it with the 1976 album and things that belong to the band and their licencing agents. Probably one of their representatives (or one of the members of the band) had it brought to their attention, told their legal team and are being sued in a "cease and desist" form.
Again, you could sue anyone for anything. But if it has gotten that far, the hotel has probably been using licenced material and using it to tie their hotel to the Eagles brand. That does happen a lot also. Usually it is taken down, changed and settled for an "Undisclosed sum." But the Eagles have some pretty good attorneys. Probably wouldn't be a good idea to go after them.

I've been to that hotel in Mexico.... If memory serves me well.... it was around long before the song... and I don't remember any Eagles "items" there at all. That was back in about 2005.... and maybe the management has changed things a little lately.

I'm NOT saying this is an appropriate lawsuit. I don't know anything about it. Only offering thoughts about what it COULD be. If they brought a suit, could be something, could be nothing. They are quite a litigious bunch. Of course when you have large attorney firms, you can do that. Like I said, they also sued a group in California, who saved Eagles in the wild for using the name also. The bird was around before they were also.
In all probability it is simply a warning to people who MIGHT want to violate trademarks. If that hotel didn't do that, probably have nothing to worry about it. It is why I don't enforce my copyrights on the words "Love, You and I." I let people use them freely and rarely sue anybody.

The Hotel California (in Mexico) lawsuit will probably be settled out of court... but my best guess is aimed at Marketing 103... "any publicity is good publicity"... at least in "the Biz" with an established "brand"... or in this case, BAND! LOL!
Brian, my friend and co-writer back in our early days was Mike Hackworth. He wrote a song called "No Fault Divorce" and it's greatest claim to fame... it was played on the Regis and Kelly show and we actually received a payment. After the "splits" kicked in, I believe there was enough money left to buy a burger and a cup of coffee. I hope your "Peaceful Pal" is rolling in the dough cause it was/is a great song. Good to see you posting often and obviously feeling better.
I have just enough time to navigate back up to Colyer's playlist for one more spin of an Eagles song. Great group.
