Yesterday the Brabec Brothers gave a talk in Austin at the Austin Music Foundation Boot Camp

One of the topics they brought up was

Copy Right Termination:

Even if a writer has signed the publishing on a song to a publisher, after a number of years, the writer has the right to get the publishing to their song back

2 year reversion clause seems as a general consensus the way to go from a writer's perspective...they have time to work it, if they don't before you go terribly gray you get it back..MJ

Without looking it up if a song is recorded and released the Publisher has the song for a number of years. I think is for a total of 40 years and 35 years after the first release before a songwriter can re-claim his copyright.

If a song is sucessful I don't know why someone would go thru the process of re-claiming the copyright if it is producing royalities. I think in the old days the only way a songwriter could exploit his songs was sign them to a publisher. Today you can act as your own publisher if desired.

Rule of thumb over here in the UK.....5years max is the norm..
Thats with the publishers i have dealt with anyway..Their brief is to exploit the "work"...to the best of their ability.After the term is up, you can either re-negoiate with the same publisher..move to another one,or handle it yourself...of course the publisher has the same option too, whether to continue to represent the "work"....Terry Moore....

If the publisher gets a cut by a unknown artist that goes nowhere,does that count as fulfilling their obligation for the reversion clause,so now they own your song for 40 years?

I suppose that would be true. However there is no restriction that if a song does not sell so many copies in a shorter time you could have the song revert back to you. You could put in the reversion clause that if the song did not sell, say 10,000 copies in 5 years the song reverts to the songwriter. Something to think about if signing with a small publisher.

Most contracts have some form of this involved. But the publisher also has the right to be reimbursed for their costs involved. So if they paid for the demo, a song plugger to pitch it, salaries, expenses, etc. One of the reasons a lot of writers don't go get some of their old songs are that they can be very expensive to do so. Particularly if the song has earned no money.

Usually better just to write more songs.

This appears to be a pretty old thread, Ande and Marc... but it is an important topic to anyone serious about their songs and any contracts that might result.

I get ASCAP's daily newsletter and about half of the techno-babble is about how congress is considering changing just about everything connected to copyright law... and, unless you have time to read this legaleze on a daily basis... how's a guy ever going to have time to write a song? No matter what happens, I'm prepared to receive the short end of the stick... 'cause that is what always seems to occur to those of us with no voice or representation in the argument or discussion.

Songwriting is probably the most unrewarding endeavor an individual can pursue. But hey, at least I don't live in North Korea.

True, 99% of the time splits on songs determine how you split the expenses
Only go after songs that made & are making money
It gives writers who signed away their publishing a chance to get it back
So if I was a writer who had a hit in 1980 I'd be looking at this

Learning the Music Business for the average songwriter is mostly a *ain in the *ss but should be a priority for the songwriter. Most people in the Music Business are good people but there is also the other kind! Re-Claiming your Copyright after 35 or 40 years is part of Copyright Law but probably require's the songwriter to take the Action. After 40 years if the song is still making money it is probably best to leave it where it is unless you want to do the administration.
